The international trade between an exporter and an importer has been developed to present state over the years and methods of payment between the parties (seller and buyer) has become a significant issue in the world of import-export trade. There are many methods of payment prevailing , out of them ‘letter of credit’ has become the most popular method of payment, originated in concrete form in 1932 in commercial practice; 1  it has wide-spread international acceptability now in the trade world; because it is a safe method of obtaining payment.

A letter of credit (L/C) is a banking mechanism which allows importers to offer secure terms to exporters while transacting a ‘export-import contract’ between them.

The  issuing bank’s role is two-fold 2 :

* to guarantee to the seller that if compliant documents are presented, the bank will pay the seller the amount due. This offers security to the seller – the bank says in effect “We will pay you if you present documents (XYZ)”.

* to examine the documents, and only pay if these comply with the terms and conditions set out in the letter of credit. This protects the buyer’s interests – the bank says “We will only pay your supplier on your behalf if they present documents (XYZ) that you have asked for”

The stages of the letter of credit are 3 :

1. Buyer and seller agree terms, including means of transport, period of credit offered (if any), latest date of shipment, Incoterm to be used.

2. Buyer applies to bank for issue of letter of credit. Bank will evaluate buyer’s credit standing, and may require cash cover and/or reduction of other lending limits.

3. Issuing bank issues L/C, sending it to the Advising bank by airmail or (more commonly) electronic means such as telex or SWIFT

4. Advising bank establishes authenticity of the letter of credit using signature books or test codes, then informs seller (beneficiary). Advising bank MAY confirm L/C, i.e. add its own payment undertaking

5. Seller should now check that L/C matches commercial agreement, and that all its terms and conditions can be satisfied, If there is anything that may cause a problem, an AMENDMENT must be requested.

6. Seller ships the goods, then assembles the documents called for the L/C (invoice, transport document etc.) Before presenting the documents to the bank, the seller should check them for discrepancies with the L/C, and correct the documents where necessary.

7. The documents are presented to a bank, often the Advising bank. The Advising bank checks the documents against the L/C. If the documents are compliant, the bank pays the seller and forwards the documents to the Issuing bank.

8. The Issuing bank now checks the documents itself. If they are in order (and it is a sight L/C), it reimburses the seller’s bank immediately.

9. The Issuing bank debits the buyer and releases the documents (including transport document), so that the buyer can claim the goods from the carrier.

The International Chamber and Commerce has developed certain rules concerning letters of credit and are known as UCP (Uniform Customs and Practice for Documentary Credits ) 500 revision or UCP 400 revision. The English law does not recognize that UCP has the force of law or the status of a trade customs. Article 1 states that :

“The Uniform Customs and Practice for Documentary Credits, 1993 Revision, ICC publication No. 500, shall apply to all documentary credits (including to the extent to which they may be applicable….They are binding on all parties thereto, unless otherwise expressly stipulated in the credit.” 4, Thus UCP will be applied in English Law if the parties have incorporated them into their contract.

The law relating to Letters of credit is founded on two principles 5  :

a)    The autonomy of the credit ; and
b)    The doctrine of strict compliance.

When the seller presents the documents under the letter of credit for payment, he is assured of payment as long as the documents are conforming and all other conditions in the credit have been properly met. It is not open to anyone ( including the buyer) to argue that there has been a breach of the underlying contract of sale and hence, deny the seller payment under the letter of credit. The buyer is not entitled to prevent payment. His only recourse is to take legal action subsequently. The separation between the contract and letter of credit is known as principle of the autonomy of credit, which is explained in Article 3, UCP below.

Article 3 – Credits v Contracts

“ Credits, by their nature, are separate transactions from the sales or other contract(s) on which they may be based and banks are in no way concerned with or bound by such contract(s), even if any reference whatsoever to such contract(s) is included in the credit. Consequently, the undertaking of the bank to pay, accept and pay draft(s) or negotiate and/or to fulfill any other obligation under the credit, is not subject to claims or defenses by the Applicant resulting from his relationship with the issuing bank or beneficiary.”
Article 4, UCP explains relationship between documents and goods, services, performances as below :

“ In credit operations all parties concerned deal with documents, and not with goods, services and/or performances to which the documents relate.” 6

The autonomous character of a letter of credit became inevitable in that banks deal in finance, not in goods. Thus , a bank which agrees to operate a credit is solely concerned with the documents tendered by the seller which have been referred to in the contract; it is not concerned with the nature of merchandise in the underlying contract. A letter of credit contract may be described as a money contract which is solely concerned with payment; thus its validity as payment contract is to be confirmed, and the bank agreeing to accept the contract is concerned with the validity of the letter of credit of the contract, which entails examining the documents related to that contract. 7

By virtue of its autonomous character, a letter of credit is compared with a bill of exchange. In Power Curber International Ltd. v National Bank of Kuwait, Lord Denning said that :

“ A letter of credit is like a bill of exchange given for the price of goods. It ranks as cash and must be honoured.” 8

Thus, an undertaking to honour a letter of credit unless fraud exists, is of absolute nature, and the relevant banks is in “no way concerned with any dispute that the buyer may have with the seller”. 9

It is evitable from the above discussion on the legal autonomous characteristics of the letter of credit, in the eyes of law, the court treats a letter of credit is equivalent to cash in hand; only thing is that documents submitted by the seller to the bank must conform with the documents asked and conditions are met as per the letter of credit contract.

If a letter of credit is not treated by the court as cash in hand , the international trade could become impossible and standstill like thrombosis ( prevention of blood flow and formation of blood clots) occurs in our blood stream. Obtaining payment is the vital part of any trade; where the international trade involves with the cross-border trade transactions, no law of any country could guarantee the payment of the trade if the letter of credit is not developed and honoured as cash in hand.

ভাবনা-১  || ১৮ জুন ২০১৩
‘বেইরা’ (মোজাম্বিক) থেকে ‘ডারবান’ (সা.আফ্রিকা) মাত্র আড়াই দিনের পথ l দক্ষিন বরাবর সোজা নিচে নামলেই হয়ে গেল l কোন সেকেন্ড মেটের জন্য এর চেয়ে সহজ প্যাসেজ প্ল্যান আর হয়না l দিগন্তজোড়া নীল সাগর-আকাশের মহামিলন দৃশ্য, অদ্ভুত সুন্দর তারাময় পূ্র্ণিমা রাত, নীল তিমির জল-ক্রীড়া আর ডলফিনের মিছিলের স্মৃতি পেছনে ফেলে প্রায় ঠিক সময়েই ‘ডারবান’ পৌঁছালাম l যাত্রা পথে আরও জাহাজ দেখলাম, গম্ভীর-ব্যস্ত পথিকের মতো ওরা সবাই নিজ পথে চলছে আপন গন্তব্যে! পথ তো পথিকের পানেই চেয়ে থাকে l পথিক শূন্য পথ, তারা বিহীন রাতের অন্ধকার আকাশের মতোই নিষ্প্রান!

আমরা সবাই – প্রত্যেকটা মানুষ বিরামহীন ছুটে চলেছি নিজ নিজ লক্ষ্যপানে l বিশেষ করে ছাত্র, যুবক, তরুন পেশাজীবি-ব্যবসায়ী-রাজনীতিবিদ সবারই নিজস্ব স্বপ্ন আছে l কিন্তু নিজের কাছেই যদি সেই স্বপ্নযাত্রার লক্ষ্য পরিষ্কার না থাকে, সাথে যদি চেষ্টা ও পরিকল্পনায়ও ত্রুটি থাকে, তাহলে পথের শেষ দেখা আসলেই কঠিন l ‘এইম ইন লাইফ’ যাতে ‘পেইন ইন লাইফ’ এ রূপ না নেয়, সেজন্যে শুরু থেকেই চাই নিখাদ প্রস্তুতি l তুমি যদি এ সফরের এক মুসাফির হও, তোমাকেই খুঁজে নিতে হবে সঠিক রাস্তা l এক্ষেত্রে পথ পথিককে নয়, পথিককেই পথ চিনে নিতে হবে l তা না হলেই বিপত্তি l আর এ বিপত্তি তোমায় পরিণত করবে কম্পাসবিহীন এক দিশেহারা নাবিকে l বিভ্রান্ত আর হত-বিহবল হয়ে হয়তো মনে মনে আওড়াবে তখন… ‘আরে!, যাবো ঠিক করলাম মঙোলিয়া, কিন্তু কিভাবে যে এসে গেলাম সোমালিয়া….!!’

ভাবনা-২ ||  ১৪ জুন ২০১৩

ছবিতে যে ‘গার্ডেন প্ল্যান্ট’ দেখতে পাচ্ছেন ওটার নাম ‘ব্রোমেলিয়া’ l প্রায় বছর দুয়েক আগে জাহাজের নেভিগেশন ব্রীজের একটি টবে লাগিয়ে ছিলাম l শুধু মাত্র একটি পত্র-গুচ্ছ ছিল গাছটার সম্বল l এখনতো পাতায় পাতায় ভরে গেছে গাছটা l কিছুদিন আগে জয়েন করলাম সেই একই জাহাজে l খুব ভালো লাগলো টবটা দেখতে পেয়ে l বুঝাই যায় বেশ যত্ন পেয়েছে ও l এ দুই বছরে নেভিগেশন ব্রীজে পর্যায়ক্রমে দায়িত্ব পালন করা অফিসারদের তালিকা করতে গেলে অনেক লম্বাই হবে তা l গাছটার দিকে সবাই ভালো দৃষ্টি রেখেছিল বলেই এতটা দৃষ্টি-নন্দন হতে পেরেছে ওটা l এক ইউক্রেনিয়ান অফিসার তো নাকি কিভাবে প্ল্যান্ট এর যত্ন নিতে হয় তার একটা নির্দেশনামূলক পোস্টারও ঝুলিয়ে দিয়েছিল টবটার পাশে l
………..
আমরাও কি কম যত্নবান আমাদের নিজেদেরকে নিয়ে ? সবাই-ই তো নিজেকে, নিজের পরিবার-বাড়ী-গাড়ী-অফিস ইত্যাদী সুন্দর করে সাজানোর জন্য কত পরিকল্পনা করি… সাজাইও l এ ব্যাপারে সবাই খুব সচেতন আর চেষ্টার কমতিও নেই কারো l কিন্তু দুঃখ লাগে তখন, যখন দেখি এই একই মানুষদের নিজের সমাজ ও দেশকে নিয়ে সুন্দর কোন পরিকল্পনা নেই l দেশ ভালো না থাকলে নিজের ভালো দিয়ে কি হবে ?
কখন আমরা আর আমাদের নেতারা একটা সুখী-সমৃদ্ধশালী-সুন্দর দেশ গড়ার জন্য ভাববো ?

ভাবনা-৩  || ২৯ জুন ২০১৩
‘ম্যান্ডেলা’র দেশ সাউথ আফ্রিকায় আছি গত ১০ দিন ধরে l এই ভদ্রলোকের বয়স ৯৫ প্রায় l অসুস্থ হয়ে হাসপাতালে ভর্তি হবার পর থেকেই পৃথিবীজুড়ে তাঁর জন্য শুভ কামনা আর প্রার্থনার নজিরবিহীন ব্যাকুলতা শুরু হয়ে গেছে l কেউ দ্বিমত করবেন না মনে হয় – ‘নেলসন ম্যান্ডেলা’ জীবন্ত কিংবদন্তি বলতে যা বুঝায় তার চেয়েও বেশী l অধিকার আদায় সংগ্রামের অপরাধে জীবনের প্রায় এক তৃতীয়াংশ তিনি কাটিয়েছেন জেলখানার অন্ধকারে l হাল ছাড়েননি কখনো শত অত্যাচারের পরও l মুক্ত হয়ে দেশবাসীকেও মুক্ত করেছেন দাসত্বের শৃংখল থেকে l বিশ্ববাসীর কাছে নিজের মর্যাদা পৌঁছে দিয়েছেন হিমালয়সম উচ্চতায় l দেশ পরিচালনায়ও অতিক্রম করেছেন সাদাদের l নিজেকে পরিণত করেছেন বর্তমান দুনিয়ার নেতাদের নেতায় l সবাইই চায় উনি সুস্থ হয়ে আবার ফিরে আসুন আমাদের মাঝে l

দুই চাকার গাড়ী সাইকেল চালানোর হাতে খড়ি হয় আমার ফনিক্স বাই-সাইকেল দিয়ে l ধরে নেয়া যায় আমাদের প্রজন্মের প্রায় সবাই চালিয়েছেন এটা l পেছনের ক্যারিয়ার/সিটেও চড়েছেন সবাই l আবার চালকের সিটের সামনের ক্যারিয়ার (পাইপ) এ চড়ার অভিজ্ঞতা যাদের আছে তারা জানেন এটা কতটা কষ্টকর l আর রাস্তা যদি আমাদের পুরান ঢাকার মতো হয়, তাহলেতো পেছনের ব্যাথা সারানোর জন্য ‘ঝান্ডু বাম’ও যথেষ্ঠ হবে বলে মনে হয়না l অবশ্য নাটক-সিনেমায় দেখে থাকবেন, নায়িকাকে সামনে বসিয়ে নায়ক গল্প শুনিয়ে প্যাডেল মারছে আর নায়িকাও হাসি মুখে মুগ্ধ হয়ে তা শুনে যাচ্ছে… সেটা ভিন্ন ব্যাপার… অভিনয় শিল্প বলে কথা… !
কিন্তু আমাদের নেতারা যে সেই নায়কের মতো আরাম সিটে বসে যুগ যুগ ধরে আম-জনতাকে সামনের সিটে বসিয়ে একের পর এক বাসী গল্পগুলো শুনিয়ে যাচ্ছে তার কি হবে ?
আমরা কি আগেই ‘পেইন কিলার’ নিয়ে বসে আছি ?
নাকি ‘পেইন প্রুফ’ হয়ে গেছি ??
ম্যান্ডেলা’র মতো নেতা না হোক, ওর কোন শিষ্যও কি আমরা পাবনা ???

শৈশব-কৈশর-যৌবন পেরিয়ে স্বদেশ পরিণত বয়সে পৌঁছেছে অনেক আগেই l
এখন আর ফনিক্স সাইকেল নয়, ফনিক্স পাখির মতো উড়াল দিয়ে চলতে চাই সমৃদ্ধির পথে l

বিখ্যাত অমুসলিম পন্ডিতদের মধ্যে জর্জ বার্নাড শ, টমাস কার্লাইল, মহাত্মা গান্ধী, ফিলিপ কে. হিট্টি, এম.এন রায়, ড. মরিস বুকাইলি, ড. কিথ মূর, গ্যারি মিলার প্রমুখ ‘ইসলাম, আল কোরআন ও মুহম্মদ (সঃ)’ কে নিয়ে বেশ কিছু গবেষণা মূলক লিখা লিখেছেন l যেখানে এই মহাগ্রন্থকে অবিসংবাদিত, বিজ্ঞানময় আর সর্বগ্রহনযোগ্য হিসেবে বর্ণনা করা হয়েছে আর ইসলাম ও রাসুল (সঃ) কে মানবতার জন্য আশীর্বাদ হিসেবে গন্য করা হয়েছে l

ড. মরিস বুকাইলি তার বিখ্যাত ‘The Bible The Quran and Science’ এ বলেছেন, ‘The Quran does not contain a single statement that is assailable from a modern scientific point of view.’
জর্জ বার্নাড শ বলেন – ‘আমার মনে হয় এটাই একমাত্র ধর্ম – যা জীবনের পরিবর্তিত ধাপের সঙ্গে একাত্মীভূত হওয়ার ক্ষমতা রাখে । সেই কারণে প্রতিটা যুগেই আছে এর (সমান) আবেদন । আমি বিশ্বাস করি, যদি মুহাম্মাদ (সঃ) এর মতো একজন মানুষ আধুনিক বিশ্বের একনায়কের পদ অধিকার করতেন, তাহলে তিনি এমন সাফ্যলের সঙ্গে এর সমস্যা গুলির সমাধান করতে পারতেন, যা এর জন্য প্রয়োজনীয় সুখ ও শান্তি বয়ে আনত ।(Genuine Islam; vol. 1)’

আফসোস,
আমরা মুসলমানরাই এখনো সঠিকভাবে আল্লাহ ও তাঁর রাসুলকে বুঝে উঠতে পারিনি…
ঈমানের দাবীর মর্মার্থ হৃদয়ে গাঁথতে পারিনি…
দুনিয়ার মানুষের কাছে কোরআন ও হাদীসের আলোকময় বার্তা পৌঁছে দিতে পারিনি l

ভূমধ্য সাগরের দক্ষিন-পূর্ব তীর ঘেঁষে আর নীল নদের অববাহিকায় গড়ে উঠা পৃথিবীর সবচেয়ে পুরানো মানব বসতির ইতিহাস প্রায় ৬০০০ বছর খ্রীষ্টপূর্বের l তিন লক্ষ নব্বই হাজার বর্গমাইলের মিশরের ৯৬%ই মরুভুমি l পুরো দেশের মাত্র ৫% ভূমিতেই বসবাস আফ্রিকার সবচেয়ে জনবহুল এ দেশের ৯৯% মানুষের l গ্রীষ্মে যেমন তীব্র লু-হাওয়া বয়ে যায় লোহিত সাগরের পাড় ধরে, তেমনি আবার পশ্চিম সীমান্তে তুষার বৃষ্টিরও দেখা মেলে শীত কালে l প্রাগৈতিহাসিক কাল থেকেই শিক্ষা-সাহিত্য-সংস্কৃতি-বিজ্ঞান সবদিক থেকেই মিশরীয় সভ্যতা এক বিরাট বিস্ময় সারা দুনিয়ার কাছে ! ধন্য আমি, এ বিস্ময়ের কাছাকাছি যাবার সৌভাগ্য হয়েছে আমার কয়েকবার l

‘মিশর’ আরবী শব্দ l আর ‘Egypt’ নামটা এসেছে পৌরনিক গ্রীক ‘Aígyptos’ , ফরাশী ‘Egypte’ ও ল্যাটিন ‘Aegyptus’ শব্দত্রয়ের সংমিশ্রনে l

পঞ্চাশের দশক থেকেই আধুনিক মিশরের ইতিহাসে একনায়কতন্ত্রের সূচনা হয় জামাল নাসেরের হাত ধরে l তার যোগ্য উত্তরসূরী হিসেবে আনোয়ার সাদাত ও হোসনী মোবারক দেশ চালায় পশ্চিমা ধাঁচে l দূর্নীতি, নিজেদের আখের গোছানো আর কঠোরহস্তে বিরোধী দমন নিয়ে ব্যস্ত সরকারগুলোর দেশ পরিচালনায় ব্যর্থতারই ফল ২০১১ সালের ফেব্রুয়ারীর ‘মিশর বিপ্লব’ l যার ধারাবহিকতায় ২০১১ সালের নভেম্বরের জাতীয় নির্বাচনে যুগ যুগ ধরে নির্যাতিত ইসলামপন্থীরা জয়ী হয়ে দেশ পরিচালনার দায়িত্ব পায় l পশ্চিমা প্রভাবান্বিত বুরোক্র্যাসী ও সেনাবাহিনীর দীর্ঘ টাল-বাহনার পর ২০১২ এর জুন মাসে ক্ষমতা গ্রহন করে প্রেসিডেন্ট মুরসি l অবাক পশ্চিমা দুনিয়া চুপ করে বসে থাকেনি l এক বছর পার হতে না হতেই যার ফলশ্রুতিতে নানামূখী ষড়যন্ত্রে রক্তাক্ত দীর্ঘ আন্দোলনের ফসল ‘মুরসী সরকারে’র পতন ঘটালো তথাকথিত দেশপ্রেমিক সেনা বাহিনী, যারা গত পঞ্চাশ বছরেরও বেশী সময় ধরে স্বৈরাচারকেই সাহচর্য দিয়ে এসেছে হাজার হাজার স্বদেশীর রক্তে নিজেদের হাত রাঙিয়ে l তারাই সর্বশক্তি দিয়ে শেষ চেষ্টা করে দমাতে চেয়েছিল মোবারকের বিরুদ্ধে সংগ্রামরত মিশরীয়দের l

চক্রান্তকারীদের সাময়িক বিজয় মিশরের নব-দিগন্তে উদীয়মান সূর্যের উপর হালকা মেঘের আবরন মাত্র, যা পাল্টা-বিপ্লবের দমকা হাওয়ায় হারিয়ে যেতে পারে যে কোন সময় l

তুরস্কের অটোম্যান শাসনামলের কোন এক সময়ে এক প্রতাপশালী সম্রাট তাঁর মৃত্যুশয্যায় রাজসিংহাসনের উত্তারিধিকারী বড় ছেলেকে ডেকে নিয়ে বললেন-‘তোমাকে একটা শেষ অনুরোধ করি আমি, আশা করি নিরাশ করবেনা আমাকে l আমার মৃত্যুর পর দাফনের সময় আমার প্রিয় মোজা দুটি সাথে দিয়ে দিও, সাবধানে দিও- কেও যাতে দেখতে না পায় l’ ছেলে ভাবলো – এ আর এমন কি কঠিন কাজ ! কথা দিল সে তার বাবাকে যে কাজটা করে দেবে l বাবার মৃত্যুর পর যথারীতি নিজ হাতে দাফনের সময় সবার অগোচরে পুত্র বাবার কাফনের ভেতর মোজার ছোট্ট পুটলিটা ঢুকিয়ে দিতেই পাশেই উপস্থিত কয়েকজনের কাছে ধরা পড়ে গেল l ওরা বাধা দিল, মুরুব্বীরা তিরস্কার করল l ক্ষমতাধর হওয়া সত্বেও কোন মতেই সে কাউকে এ ব্যাপারে রাজী করাতে পারলো না l এক বাক্যে সবাই মতামত দিল, মৃত্যুর পর কাফনের কাপড় ছাড়া মূর্দা আর কিছুই সাথে নিয়ে যেতে পারবেনা l সামাজিক ও ধর্মীয় রীতির বরখেলাপ করা যাবেনা l দাফন শেষে তিনি প্রাসাদে ফিরে আসতেই প্রধান উজির একটা চিঠি দিয়ে বললো যে, মরহুম সম্রাট এটা মৃত্যুর পূ্র্বে তাকে দিয়ে আদেশ করে ছিলেন যে, তাঁর মৃত্যুর পর পরই যেন তাঁর ছেলের কাছে এটা হস্তাতান্তর করা হয় l ভাবী রাজা চিঠিটা পড়তে শুরু করলেন- ‘দেখলে তো, আমার মতো এক মহাপ্রতাপশালী রাজা মৃত্যুর পর সামান্য একজোড়া মোজাও নিজের সাথে নিয়ে যেতে পারলামনা, অথচ কতইনা ক্ষমতাশালী আর ঐশ্বর্যশালী ছিলাম আমি l শোন, সম্পদ সঞ্চয়ের পেছনে দৌঁড়ে সময় অপচয় করোনা l ততটাই সম্পদ রাখো, যতটা দরকার তোমার আর তোমার পরিবারের জন্য l বাকীটা ব্যয় করো প্রজা আর রাজ্যের জন্য – মানুষের মংগলের জন্য l’

উপরের কাহিনীটা বলছিল তুর্কী নাগরিক ওমর হাকান, জাহাজের সদ্য বিদায়ী ইলেক্ট্রিক্যাল ইঞ্জিনিয়ার l জব কনট্রাক্ট শেষে জাহাজ থেকে নেমে আমরা একসাথেই ডারবান এয়ারপোর্ট যাচ্ছিলাম l নানান আলাপচারিতার ফাঁকে গল্পটা শোনাল সে l সদিচ্ছা থাকলে নিজেদের আয়ের ছোট একটা অংশ আমরা সমাজের জন্য, মানুষের কল্যানের জন্য খরচ করতেই পারি l

The same unblinking eyes seemed to bore into my very soul every time I looked out towards the sky. She was a bedraggled sight in the midst of everything. Her wiry, stringy hair hung limply down her back, barely covered by the rags she wore. Yet what stared insolently from the pallor of her face was a pair of intense eyes framed by dark circles of fatigue. Where her entire being looked lifeless and worn, the eyes remained focused and alert, undaunted by the wrought iron gates.

She had remained in that same position every single day for the last week whenever I was within the walls of my immense mansion. Each day only caused the burden of guilt weighing me down to intensify. My face now manifested the wretchedness that was swallowing my heart and soul leading me to wonder how long before the brunt of it would simply shred me to bits. The moment was captured like a grotesque picture, eternally imprinted in my memories.

The gaunt and elderly gentleman had just stepped off the pavement. The little girl by his side was, fortunately for her, a little slower and thus saved from harm as I watched with numb horror, my speeding form crash into the man with such tremendous force that he was flung off a few meters ahead. The girl’s distraught screams and the thud of human bone impacting heavily on the hard road surface rung in my head like hell itself. In that moment of utter trepidation and panic, selfish thoughts were all my willpower and weak judgement could muster. Simply revving up my Porsche engine I drove away the guilt, fear and shame multiplying and proliferating.

The erratic thumping of my heart driving me into a deep set panic, I could still see the headlines splashed vividly across the front pages as I held the newspapers with trembling hands. They ranged from the speculation of the irresponsibility and heartlessness of the hit and run driver who had robbed little Sue of her only living relative, to outright condemnation of her cowardice at fleeing the scene. It was fortunate that our little neighbourhood could hardly trace this unidentified person and it was with guilty relief I found out that little Sue was vocally impaired. The accident bore no eye witnesses. Not that I was too particularly worried, the local police department was too busy settling their own internal differences and it would be simply foolish for them to try and arrest the single sponsor who has been funding and pumping in enormous amounts of money for them.

Her speech may be impaired but her drive was relentless. She would not rest until I had paid for the death of her beloved grandfather; she was determined to trail me until I realised the full enormity of my crime, even if that meant that she might eventually die doing it. Her blind relentlessness was born of a chillingly simple understanding: this heartless creature must and would pay.

It was something I was only beginning to understand.

PSLE is around the corner. That means that this year’s batch of Primary 6 is grueling hard to attain a score good enough to get them into their dream schools.

The Primary School Leaving Examinations, widely abbreviated as the PSLE, is one of the many national exams in Singapore that cause stress among many of our youths today.

Self-expectations, expectations from parents, relatives, uncles and aunties, all add up to their stress level. However, this stress isn’t necessarily bad. It helps to motivate the pupil.

Having taken the PSLE last year, I can very well say that PSLE isn’t as difficult as you may imagine it to be. Reason being, MOE has to think of all the average/below average pupils in Singapore. If the paper ends up being too difficult, they will barely pass. Hence, the papers, I would say are fairly moderate.

However, MOE can’t set a paper so easy that even below average pupils can ace. Therefore, among all the easy questions, there will be a certain few, that will make you think deep that certain pupils of a higher ability will be able ace.

Therefore in this article, I’ll give my fellow PSLE juniors or even the others who are going to take the same exam in the next few years a few tips 🙂

1. Don’t burn the midnight oil.
It is always important never to stay up until midnight studying. Reason being, the next morning you will probably find yourself too lethargic to even go to school, or doze off in between classes. Attention during classes is necessary as you are learning new things every single day. Make sure you are energetic for the next day. Going to sleep at around 10:00-10:30 pm is advisable.

2. Don’t over study.
Yes, of course, we say it’s good to be hardworking, because hard work is the key to success. However, over studying isn’t good either. Studying too much at once can cause you to forget more easily. So therefore, study slowly and digest what you are learning slowly. Slow and steady wins the race.

3. Always revise what you have learnt.
After coming back from school everyday, take an hour or so to look through everything that you have learnt for the day. This helps to refresh your memory and it also helps to remember things better. There are many ways you can remember your notes
For Example:

Highlighting the notes in yellow/bright colors
Drawing out the notes
Making it vibrant
Writing notes/mind maps

Revision for the PSLEs should never be left for the last minute as it won’t help much, except merely adding on to the stress before PSLE nights. Always revise early and daily so that the pressure on the night before the PSLEs is minimum.

4. Reflect back on your mistakes and summarize them.
During my PSLE year, what I used to do was to create a list of all the spelling/grammatical/common mistakes I made. Creating a list makes it easier to reflect back on mistakes so that won’t be repeated in future. Summarizing your mistakes makes sure you don’t have to go through the trouble of finding them all over again when revising and it’s also easy to bring along on the day of the PSLE other than bringing along a whole file of worksheets.

5. Spend some of your time with your hobbies/interests
This is very important. As the saying goes “All work and no play makes Jack a dull boy”

Always remember to spend at least an hour everyday on once a week engaging in your hobby, as it helps you to refresh and cleanse your mind. Studying continuously will make your brain go haywire that is why it is always good to have a 10 minutes break after 1.5 to 2 hours of studying. It might be reading a book, gazing out of the window or even listening to music.

6. Exercise and keep healthy
This brings me back to my 5th point. Studying without any physical activity affects you adversely. Exercise and eat healthily for a healthy outcome of mind and body. At this stage, it is not appropriate for anyone to go on a diet to lose weight as this is our growing period. Make sure you eat moderately and also exercise regularly. Spend 30 minutes of your evenings exercising at least twice a week or so. Keeping healthy will ensure your well-being so that you do not miss classes and also you can keep a fresh and open mind for digesting notes. Drink lots of water and keep fit as at this point of life, falling sick will be the last thing that you would wish for.

Everyone has their expectations. Make sure that your expectations are realistic. If you are someone who always scores a ‘B’, then don’t expect yourself to reach an A* overnight. Work towards an ‘A’ first and gradually work towards an A*. Remember ‘Slow and steady wins the race’

On the other hand, if you are consistently scoring an A or A*, remember to never become complacent. Always try to keep up to your level or even so, do better.

Everyone wants to go to the dream school of their choice. For me it has always been a dream to go to one of the top few schools in Singapore. National Junior College is one of the finest schools in Singapore.

Our very own prime minister, Lee Hsien Loong was from NJC.Along with him are many of our other ministers for example Vivian Balakrishnan (Minister of Environment) , Ng Eng Hen (Minister of Manpower), Gan Kim Yong (Minister of State of Education) and the list could go on.

NJC always had a very good reputation of producing fine scholars and amazing A’level results. It is one of the top 5 junior colleges in Singapore.NJC offers a holistic education and needs a minimum of 255(2013 cut-off point) to get into the school, for O’ levels an outstanding score of 5 points.

NJC has a very fun-filled environment with top notch facilities. The NJC environment is very friendly and conducive. The school is huge and amazing. NJC focuses a lot on not only academics but also so much more on the building of one’s character. Being one of the top 5 secondary schools in Singapore-it has produced many President Scholars and talented young people.

I would like to end this article by saying that PSLE isn’t the only exam in your life. There are so many others to come. Infact, its just the beginning of this learning journey.It doesn’t matter where you study ,which school you study in, because at the end of the day it all depends on you as an individual and the sweet fruit of your hard work.

আমি তখন ইরানি জাহাজে কর্মরত৷ ১৯৯৬ সাল৷ রাজনীতির আকাশটিতে সামান্য একটু ঝড়ো হাওয়ার পর গনতান্ত্রিকভাবে প্রথম ক্ষমতার হাত বদল হয়েছে৷ বেগম খালেদা জিয়া ক্ষমতা থেকে ‘আউট’ হয়েছেন৷ আর ‘ইন ‘ হয়েছেন শেখ হাসিনা ওয়াজেদ৷ ইরানিয়ান এক ফিটার তখন আমাকে জিজ্ঞেস করে, “আগা ( জনাব ), তোমার দেশে হয়েছেটা কি? এক ভদ্রমহিলা ক্ষমতা থেকে বিদায় নিয়েছেন৷ সাথে সাথে অন্য আরেক জন ক্ষমতায় এসে পরেছেন৷ সত্যি করে বলতো দেখি, তোমাদের দেশে কি আসলেই কোন পুরষ নাই?”

বললাম, “থাকবে কীভাবে বলো? ঘর সংসার, বাচ্চা-কাচ্চা, রাষ্ট্র ইত্যাদি চালানোর ভার নারীদের উপর অর্পন করে আমরা সব পুরুষেরা যে জাহাজে চলে আসি৷”

একটা ম্যারাথন হাসি ছড়িয়ে পরলো পুরো কন্ট্রোলরুম জুড়ে৷ বললাম, দেখো এই জাহাজ চালানোটি আসলেই কঠিন৷ বিপরীতক্রমে রাষ্ট্র চালানো পানির মত সহজ৷ জাহাজের অটো-পাইলটের চেয়ে দেশ চালানোর অটো-পাইলট মেকানিজমটি আরো বেশি অটোমেটিক৷ কাজেই ড্রাইভিং সিটে কোন লিঙ্গের ড্রাইভার বসলো সেই চিন্তা অমূলক ৷ আমাদের দেশের জনগণ কখনই অন্যান্য দেশের জনগণের মতো নিজেদের চাল-ডাল-নূন-তেল সংক্রানত ছোটখাট সমস্যা নিয়ে ভাবে না ৷ তারা ব্যস্ত থাকে কে স্বাধীনতার ঘোষ, কে স্বাধীনতার পক্ষে এই ধরনের জটিল সমস্যা নিয়ে৷ বুদ্ধিজীবীদের বুদ্ধির শতকরা ৯৯ ভাগ খরচ হয় এই সব সমস্যার পেছনে৷ ফলে কম্যান্ড সেন্টারে বা ড্রাইভিং সিটে জনতার কোন চাপ নাই৷ নারী হোক ,পুরুষ হোক – এই সিটে বসায় কোন হেরফের নাই৷ অর্থাৎ পুরুষ বসলেও যাই করতো৷ নারী বসেও এখন তাই করছেন৷

আমাদের ক্যাডেট লাইফে জনৈক অফিসারের হাবভাব দেখে আমাদের নিশ্চিত ধারনা জন্মালো যে উনার উপরের চেম্বারে কিছু গোলমাল রয়েছে৷ আমাদের ইমিডিয়েট সিনিয়র ব্যাচের একজন জাহাজের ক্যাডেট মহলে ঘোষণা করলেন, ‘বাছারা, পিতৃদত্ত এই প্রাণটির প্রতি যদি সামান্য মায়া অবশিষ্ট থাকে তবে দিনের বেলায় না পরলেও রাত আটটা থেকে বারোটার সময় লাইফ-জ্যাকেটটি পড়ে থেকো ৷’ কারন ঐ সময়টিতে তিনি ব্রীজের ডিউটিতে থাকেন৷

ঐ নেভিগেটরের যে সব আলামত দেখে আমরা কয়েকজন এই লাইফ জ্যাকেট পরে থাকার সিদ্ধান্ত নিয়েছিলাম তার চেয়েও মারাত্মক ধরনের সিম্পটম দেখা যায় রাষ্ট্ররূপী এই জাহাজটির বিভিন্ন নেভিগেটরদের মাঝে৷ জাহাজের মগজটি ত্রুটিযুক্ত হয়ে পরলে নেভিগেটর কিংবা প্রকৌশলী হিসাবে জাহাজের কাজ চালিয়ে যাওয়া কঠিন৷ কিন্তু ঘাড়ের উপর থেকে পুরো মাথাটি বিলকুল গায়েব হয়ে গেলেও মনে হয় রাষ্ট্র চালানোতে কোন সমস্যা হবে না৷

সঙ্গত কারনেই সবাই এই সব নেভিগেটরদের ঘৃণা করে৷ আবার এই ঘৃণা থাকার কারনেই ভালো ও দক্ষ নেভিগেটররা ‘পলিটিক্স’ নামক ব্রীজটিতে পা রাখতে চান না৷ মনের মাঝে থাকে সবসময় বিশ্ব সুন্দরী কিন্তু সর্বক্ষণ ঘরে থাকে বিশ্ব পেত্নী৷ আমরা টিকেট কাটি থার্ড ক্লাসে কিন্তু ভ্রমণ করতে চাই ফার্ষ্ট ক্লাসে৷ খুব কম জায়গা থেকেই বলা হয় ভালো মানুষদের, ভালো ছেলেদের রাজনীতিতে আসা দরকার৷

পরিণামে তৃতীয় শ্রেণীর নেভিগেটররাই জাহাজের ব্রীজটি দখল করে ফেলে৷ কিন্তু মন চায় লি-কূয়ান ইউ না হলেও মাহাথিরের মতো কোন দক্ষ নেভিগেটর আমাদের এই জাহাজটি চালাক৷ এ এক আজব চাওয়া৷ এ চাওয়ার জন্যেই এক-এগারেতে আকাশ থেকে কিছু ফেরেশতা নেভিগেটর নেমে আসল ৷ বাইবেলে বর্ণিত মানুষের বেশে দুনিয়ায় আসা ফেরেশতাদের অবস্থার মতো করুণ পরিণতিও দেখতে হলো এক-এগারোর ফেরেশতাদের৷

আগে মাঝে মাঝে লিখলেও এই সময়টিতেই আরো শক্তভাবে কলমটি নিয়ে নেমে পড়লাম ৷ মনের ভাবনাগুলি কাগজে লিখে তখনকার বহুল প্রচারিত যায় যায় দিনে পাঠিয়ে দিই৷ পত্রিকাটিও তা অকৃপণভাবে ছাপাতে থাকে৷ পাঠকদের অভুতপূর্ব সাড়া পাই৷ পত্রিকাটি তাদের রেগুলার কলামিস্ট হিসাবে এই অধমকে বেছে নেয়৷ আমার লেখায় একটু নোনতা স্বাদ পেয়ে কলামটির নাম রাখা হয় ‘ সাগর জলের কালি’ ৷ শফিক রেহমানের কাছ থেকে যায় যায় দিন ছিনিয়ে নেওয়ার পর বলা হয় এই ধরনের নোনতা লেখা আর লেখা যাবে না৷ বললাম,আমাকে যদি নির্দেশ দেওয়া হয় কী লিখতে হবে তাহলে আর লিখবই না৷ কারন লেখা আমার পেশা নয়, নেশাও নয়। শুধু ভেতরের একটা তাগিদ থেকেই লিখে থাকি৷

আমাদের ব্যাচের মইনুল পরামর্শ দেয় লেখায় বেশী বেশী জাহাজের কথা থাকলে আমি জাহাজের মানুষ হিসাবে টাইপড হয়ে পড়ব৷ সাধারনের কাছে তা গ্রহনযোগ্যতা হারিয়ে ফেলবে৷ পরামর্শটি দামী হলেও কেন যেন ছাড়তে পারি না৷ কারন জীবনের প্রথম প্রেমিকা ‘ নৈতিকতা ‘ এবং আরো একটু পরে জীবনে আসা সঙ্গীনি – এই উভয়ের সম্মুখে শিরদাড়াটি কিছুটা মজবুত রাখতে পেরেছি এই মেরিন একাডেমির কারনেই৷ অর্থাৎ আমার ‘সাগর জলের কালি’ তার শক্তিটি পেয়েছে এই মেরিন প্রফেশনটির কাছ থেকে ৷

ঢাকা কলেজে বাংলার শিক্ষক হিসাবে পেয়েছিলাম অধ্যাপক আবদুল্লাহ আবু সাইয়িদ সহ আরো কয়েকজন আলোকিত মানুষকে৷ হৈমন্তী গল্পটি যে স্যার পড়াতেন তিনি তার ক্লাসের সকল ছাত্রকে হৈমন্তীর স্বামী অপুর মতো রোমান্টিক বানিয়ে ফেলতেন৷ সবার মনের জানালাগুলি এমনভাবে খুলে ফেলতেন তাতে অপুর মনের দখিনে হাওয়া গুলি একই শিহরন ছড়িয়ে আমাদের সবার উপর দিয়েই বয়ে যেত৷
কাজেই যখন মেরিন একাডেমিতে চান্স পেলাম তখন মনে হল এখন রঙধনু থেকে লাল রঙ এনেও স্বপ্নের নায়িকার পায়ে আলতাটি পরাতে পারবো৷ এমন একটা রোমান্টিক মুড নিয়েই চলে আসি পাহাড় ঘেরা জুলদিয়ার সেই মেরিন একাডেমিতে৷

শাবানা,ববিতা,রোজীনা প্রমুখ নায়িকাগন বয়সে সামান্য বড় হলেও তা ধর্তব্যের মধ্যে ছিল না৷ তাদেরকে গড়পরতা স্বপ্নের নায়িকা বলেই গণ্য করতাম৷ কাজেই সবচেয়ে ধাক্কাটি খেলাম যখন দোস্তদের সাথে বিশেষ প্যারেড সহকারে গাইতে হলো, ‘মেরিন একাডেমিতে এলাম গো , ববিতা খালা -রোজিনা খালা বাঁচাও গো৷’ এভাবে বাংলাদেশ ও ভারতের যত নায়িকা আছে সবাইকে খালা ডাকা শুরু করতে হলো৷ যাদেরকে খালা ডেকেছি তারা শুনতে পেলেও নির্ঘাত জলে পড়ে মরত৷

শরীরের কষ্ট সহজেই ভুলে যাওয়া যায়৷ মনের এই কষ্টগুলি সহজে ভোলা যায় না৷ দেখলাম সিনিয়ররা একশত ভাগ স্মার্ট৷ আর আমরা জুনিয়ররা একশত ভাগ আনস্মার্ট৷ আরও যন্ত্রণাদায়ক স্মার্ট ছিলো কয়েকজন স্টুয়ার্ড৷ নিয়ম মতো সিনিয়রকে দেখামাত্রই স্বরযন্ত্রের ভলিউম সর্বোচ্চ দিয়ে বলতে হতো , স্লামালিকুম স্যার৷ সবকিছু ঠিকই ছিল কিন্তু গোলমাল পাকিয়েছে এই ওভার স্মার্ট স্টুয়ার্ডগণ ৷ বেতালে হয়তো কোন সিনিয়রকে উইশ করতে ভুলে গেছি , আবার তালে পড়ে এরকম কোন স্টুয়ার্ডকেও উইশ করে বসেছি – স্লামালিকুম স্যার৷

টেরোরাইজড হয়ে দেখলাম পেছন থেকে কয়েকটা ছায়া গর্জে ওঠলো, ব্লাডি হেল, হোয়াই উইশিং স্টুয়ার্ড ? অর্থাৎ মারাত্মক গলদ হয়ে গেছে৷ সেই ভুলের জন্যেই শুরু হলো কোর্ট মার্শাল৷

শুরু হলো ফ্রগ জাম্প, ফ্রন্ট রোল, স্টার জাম্প, এলিফ্যান্ট ওয়াক,ফ্রন্ট রোল,সাইড রোল ৷ ফার্ষ্টফুডের মত একেক বাহারি নাম৷ টের পায় যাদেরকে এগুলি খেতে হয়৷ এ্যাটেনশন হয়ে দাড়িয়ে থাকলেও শরীর ও হাতের মধ্যে সিনিয়র মহাশয় হাত ঢুকিয়ে বলেন, ‘হোয়াই গ্যাপ?’ দেখলাম দুনিয়ার আদি পাপের মতোই এই গ্যাপটি রাখাও একটা পাপ ৷ আমাদের তারেক এই গ্যাপ যথাসম্ভব বন্ধ করতে গিয়ে একদা এক সিনিয়রের হাত আটকে ফেলে ৷ সিনিয়র মহোদয়ের নিজের হাতটি বের করতে কষ্ট হলেও বলে যাচ্ছেন, হোয়াই গ্যাপ? এমন করুণ ও মজার দৃশ্য দেখেও নাকি হাসা যাবে না৷ একটু হাসলেই রিপোর্ট -টু-মি-ওয়ান- টু- থ্রি ..৷ মানে রাত একটা -দুইটা -তিনটার সময় পারস্যের কবি হাফিজের কোন গজল বা শের গেয়ে সিনিয়র মহোদয়ের ঘুমটি ভাঙাতে হবে৷

পৃথিবীর অষ্টম আশ্চর্য হলো এই সিনিয়ররা যারা উঠতে বসতে জ্বালিয়েছে পরবর্তিতে তারা কেউ শত্রু  হিসাবে গণ্য হন নাই৷ অধিকাংশই পরম বন্ধু হয়ে পড়েছেন ৷ জুনিয়র-সিনিয়রের এরকম থোকা থোকা হয়ে অনেক দীর্ঘ হয়ে পড়েছে এই গাছটি৷

পেছনে তাকালে এই থোকা বা সেগমেন্ট থেকে অনেক প্রিয় সাথী কিংবা প্রিয় সিনিয়র-জুনিয়র ঝরে পড়ার বেদনাটিও সকলের মনে বেজে ওঠে৷ এই বেদনার সারিটিও নেহায়েত খাটো নয়৷ জুলদিয়ার পাহাড়, পারকির চরের হাইকিং, ফোর-মেইন-মিজান টপ ও পাশের গ্রাউন্ডগুলিতে অনেক স্মৃতি ফেলে এসেছি৷

জানি না, প্রকৃতির কোন গোপন ক্যামেরায় গচ্ছিত সেই দৃশ্যগুলি ফিরে পাওয়ার কোন যন্ত্র আবিস্কার হলে মানব সভ্যতায় সবচেয়ে দামি আবিস্কার হবে, নাকি আমাদের আবেগ ও স্মৃতিগুলিকে বিবর্ণ করার দায়ে অভিযুক্ত হবে সেই যন্ত্রটি ৷
